Just hours after Donald Trump was officially sworn in as the 47th president of the United States, the American Civil Liberties Union of New Hampshire joined several nationwide organizations in suing the Trump administration over its birthright citizenship executive order.
The executive order, which seeks to deny certain US-born babies (children of undocumented parents and green card holders) American citizenship, contradicts the 14th Amendment that grants citizenship to people born on US soil.
The 14th Amendment was ratified in 1868 to provide a pathway for Black Americans to get the protections of American citizenship. In 1898, the law was extended to include children of immigrants born in the United States.
The order has already invited lawsuits from 22 states, and was blocked by a federal district court judge for 14 days Thursday afternoon.
In New Hampshire, the ACLU legally challenged the executive order on behalf of organizations with members that will be impacted by the order, including the New Hampshire Indonesian Community Support.
Kids denied citizenship under this order will be unable to acquire identification as they grow up, won’t have the right to vote or serve on juries, or hold certain jobs—even when they spent their whole lives in the US.
“Every child born in the United States should be born with the same rights as every other child — and that’s why the U.S. Constitution ensures that no politician can ever decide who among those born in our country is worthy of citizenship,”said SangYeob Kim, senior staff attorney at the ACLU NH in a news release. “ Trump’s executive order directly opposes our Constitution, values, and history, and it would create a permanent, multigenerational subclass of people born in the U.S. but who are denied full rights.”
